Terms of Service — SituationWare

These Terms of Service ("Terms") govern your use of the SituationWare mobile application ("the App") published by Acknowledged Development Inc. ("we", "us"). By installing or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. What the App is
SituationWare is software for shared situational awareness and incident coordination. The App connects to a SituationWare server operated by your organization. You must have a valid team code from your organization to use it.
2. Eligibility and accounts
- You must be authorized by your organization to access its SituationWare team.
- You are responsible for safeguarding your team code, callsign, and passphrase, and for all activity under your sign-in.
- You must be at least 13 years old (the App is intended for adult professionals).
3. Acceptable use
You agree not to: - use the App for any unlawful purpose or in violation of your organization's policies; - upload content you do not have the right to share, or that is unlawful; - interfere with, disrupt, attack, or attempt to gain unauthorized access to the App, any Server, or other users' data; - rely on the App as the sole system for life-safety decisions (see Section 6).
4. Your content
You and your organization retain ownership of the markers, messages, attachments, and other content you create ("Content"). You grant us a limited license to process and transmit Content solely to operate the App's features (for example, to relay your position and messages to your team). Your organization controls the Content stored on its Server.
5. Location sharing
When you grant location permission, the App shares your device location with your team. By using that feature you consent to this sharing. You may disable location sharing at any time via Android Settings.
6. No warranty; not a 9-1-1 service — IMPORTANT
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SituationWare is a coordination aid, not a replacement for official dispatch, radio, or 9-1-1 systems. Maps, positions, and data may be delayed, incomplete, or unavailable, especially in low-connectivity conditions. Do not rely on the App as your only source of safety-critical information.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACKNOWLEDGED DEVELOPMENT INC. WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED USD $100.
8. Third-party services
The App uses third-party components (e.g. OpenStreetMap map tiles via osmdroid) and links to third-party reference sites (FEMA, Ready.gov, NWS). We are not responsible for third-party content or services, which are governed by their own terms.
9. Suspension and termination
Your access depends on your organization's Server and your authorization. Your organization or we may suspend or terminate access at any time. You may stop using the App and uninstall it at any time.
10. Changes
We may update these Terms; the "Effective date" will change accordingly. Continued use after an update constitutes acceptance of the revised Terms.
11. Governing law
These Terms are governed by the laws of the State of Ohio, USA, without regard to conflict-of-laws rules.
